How Do You Qualify for Social Security Disability Benefits?

The Social Security Administration offers a couple of different types of benefits to claimants, all of which we are happy to help our clients apply for. The two most common programs that we see people applying for are Social Security Disability Insurance Benefits (SSDI) and Supplemental Security Income (SSI). There are multiple factors that go into qualifying for these programs, but here are the main differences:

To qualify for Social Security Disability Insurance benefits, you must have worked and paid Social Security Disability taxes (FICA) for a certain amount of time within the last 10 years. It is extremely important that you speak with our team about your work history, as sometimes it can be confusing on how these “work credits” are earned, and you need an expert to help you determine if you may have enough of these to qualify.

To qualify for Supplemental Security Income you are not required to have “paid into” the Social Security Administration, but you must meet specific monthly income and resource requirements. This amount can vary based on a handful of factors, and so again it is incredibly important that you call our office so that we can help you determine if you may qualify for this program.

Though the technical requirements for these programs differ, for both of these programs you must also medically qualify for assistance from the Social Security Administration. In order to be found medically disabled, you must prove that you have been or expect to be out of full-time work for at least 12 months, making less than what the SSA determines as “Substantial Gainful Activity”. Our team will work to prove this by helping to gather medical records and functioning capacity documents from you doctors, and presenting these exactly as the Social Security Administration likes to see them.

There are so many factors to consider when deciding what Social Security program(s) to apply for, and it can be very difficult to make the correct designations. Our team is fully trained on all of the programs the SSA offers, and will ensure that we file your application for any and all programs that you may qualify for. Don’t just do what you think is right, trust an expert at Nyman Turkish.

Our team offers a 100% FREE CONSULTATION to anyone that calls our Firm, and we have a NO FEE GUARANTEE on all of the work we perform. There are no upfront costs to our representation and no costs to keep your case going. In the rare instance that we are unable to get your case approved for benefits, we will not collect a cent of an attorney fee. That’s right, we don’t get paid unless you get paid.

Why Do I Need an SSD Lawyer?

Applying for disability benefits can be complicated, and requires hours and hours of work to complete. Something as simple as completing a form incorrectly can cause your claim to be denied, and in some cases you are unable to appeal these denials because of information incorrectly given. Besides being extremely long, Social Security Disability forms can be confusing, and aren’t something that you should have to tackle alone when you are already not feeling well.

It is also important that you apply for benefits quickly! If you have become disabled, you should apply for Social Security Disability benefits as soon as possible, so that any FICA work credits you have do not expire. DON’T WAIT! Once these are gone you cannot get them back.

Our Social Security Disability team is focused 100% on getting benefits for our clients, this is the only type of law that these employees work on. Let us take the burden off of your shoulders, and ensure that you are given the best chance you can get at being approved for benefits.

Besides just SSA forms, disability applications require supporting evidence and documentation to prove that the applicant is, in fact, disabled and cannot work to earn enough money to meet the substantial gainful activity threshold. We employ specific procedures and resources to ensure that all of your medical records and documentation are gathered and submitted to the SSA so that the adjudicators on your case are seeing your entire medical history. This helps us ensure that your full story is being presented, and gives you the best chance at being found medically disabled.

Because of our NO FEE GUARANTEE, there is literally no risk to our representation. When we take your case we require no upfront payment, and if we do not when your case you do not pay us an attorney fee. Attorney fees for this practice area are regulated by the government across the whole country, and so they are exactly the same for every Law Firm. No risk and no need for shopping around, seems like a no brainer to call us today.
