What are Social Security Disability benefits?

Social Security Disability Insurance (SSDI) is a federal program administered by the Social Security Administration (SSA). SSDI provides financial assistance to qualifying individuals with disabilities who have paid into the Social Security program by working and earning a sufficient number of what is known as “work credits.” Work credits are earned by paying FICA taxes, which typically come out of your payroll checks.

The SSA offers another federal program called Supplemental Security Income (SSI), which is based on the financial need of the claimant and does not require work credit minimums. This program is meant to help claimants with physical or mental disabilities that prevent them from working, and have extremely limited financial resources.

SSDI and SSI have different eligibility requirements and it can be complicated to determine which program you qualify for. As a client of Nyman Turkish, you don’t have to figure out that determination alone. Our expert team members know these programs inside and out, they work with them every day. We will work with you at every step of the process of applying for benefits, and even assist people that have not yet filed their claim. You do not have to go on through this alone, let our team help get you the benefits you deserve.

The Disability Benefits Process Outlined by a Social Security Lawyer

Applying for Social Security Disability benefits can be challenging. In fact, the majority of applications for Social Security (SSD and SSI) benefits are denied the first time. Generally, the application process for Social Security Disability benefits begins with collecting information and the documents needed to complete your disability application.

Our team is fully trained on all the programs the Social Security Administration offers, including their different application requirements, and can ensure your application has all the necessary paperwork to be processed quickly and efficiently.

There are five main stages to a Social Security Disability claim:

  1. Initial Application
  2. Reconsideration Appeal
  3. Administrative Law Judge Hearing Appeal
  4. Appeals Council Appeal
  5. Federal Court Appeal

What makes Nyman Turkish different from other Law Firms is that we can help you at any point in your claim, even if you have not yet applied for benefits. No matter where you are in these 5 stages, give our team a call for a FREE CASE EVALUATION. This call only takes a few minutes to complete and will help us determine exactly how we can help you with your claim.

We Can Help with Disability Claim Denials

After you complete your application, we will wait for a response from the SSA, which could take several months. During this time the SSA is reviewing your application to determine whether you meet their requirements for disability benefits, considering factors such as your medical conditions and your current ability to work.

Ultimately, if the decision on your Initial Application is unfavorable, our Social Security Attorneys can file a request for reconsideration to have your case reviewed again, and if needed we can file for a hearing to prove your case before a Social Security Administration Administrative Law Judge. Our team will work tirelessly to appeal the decision and continue to fight for the SSD benefits you deserve.

Do I Have to Be Permanently Disabled to Qualify for Disability Benefits?

You do not have to be permanently disabled to qualify for SSDI or SSI benefits, but you do need to meet the SSA’s definition of disability.

Although you are not required to have a permanent disability, you are required to have a disability that will have, or has already had, a significant effect on your ability to work. The SSA defines disability as “the inability to engage in any Substantial Gainful Activity (SGA) by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or disability which has lasted or can be expected to last for a continuous period of not less than 12 months.” This definition requires you to have the inability to do substantial work, but depending on the program you are applying for this does not mean that you cannot have a job of some kind.

Substantial Gainful Activity is a dollar amount that the SSA determines each year as the maximum threshold that a claimant can bring home from working and still qualify financially for Social Security Disability benefits. There are many factors that go into determining this dollar amount, and there are also some stipulations based on the type of disability a person has and their household situation. Determining how this limit applies to you can be very tricky on your own, and we suggest contacting our highly experienced team to discuss this. Do not count yourself out! We offer a FREE CASE EVALUATION that can determine your eligibility for benefits within minutes.
