SSDI vs. SSI Technical Requirements

To qualify for SSDI, you must have a qualifying disability and you must have worked and paid SSD taxes for a certain amount of time within the last 10 years to earn a sufficient amount of “work credits.” We recommend you speak with an experienced SSD attorney to determine whether you have a sufficient amount of work credits. Do I Have to Be Permanently Disabled to Qualify for Disability Benefits?

You do not have to be permanently disabled to qualify for SSDI or SSI benefits, but you do need to meet the SSA’s definition of disability. 

Although you are not required to have a permanent disability, you are required to have a disability that will have, or has already had, a significant effect on your ability to work. The SSA defines disability as “the inability to engage in any Substantial Gainful Activity (SGA) by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or disability which has lasted or can be expected to last for a continuous period of not less than 12 months.” This definition requires you to have the inability to do substantial work, but depending on the program you are applying for this does not mean that you cannot have a job of some kind. 

Substantial Gainful Activity is a dollar amount that the SSA determines each year as the maximum threshold that a claimant can bring home from working and still qualify financially for Social Security Disability benefits. There are many factors that go into determining this dollar amount, and there are also some stipulations based on the type of disability a person has and their household situation.
